Introduction
The Applicant, William Fritz, seeks approval of a special exception to operate a Short Term
Rental at 204 Corsica Street, property he owns. Here is the definition of Short Term Rental from
the Zoning Ordinance.
The property is zoned R-2. A short term rental is permitted use in the R-2 zone, but only by
special exception. The term “special exception” is defined by the Zoning Ordinance in Section
170-68 as follows.
The Application is being referred to the Planning Commission Section 170-59B1(d) of the
Zoning Ordinance], in order that the Commission might provide a comment to the Board of
Appeals about consistency with the comprehensive plan. It is the Board which must decide
whether to approve or deny the application. As provided in Section 170-57B(f), the Board must
find that the proposed special exception: “will not adversely affect the public health, safety,
security, morals, or general welfare or result in dangerous traffic conditions, or jeopardize the
lives or property of the people living in the neighborhood”.

development activities are being
proposed. No change of
character, or disruption of
historic quality, or blocking of
scenic views are indicated.
3. The neighborhood is designated
as Single-Family Residential on
the adopted Future Land Use
Plan in the 2009 Community
Plan. Pages 4-2 to 4-3 describe
general recommendations for
existing residential areas. There
is no mention of short term
rentals or bed and breakfast
establishments, though both are
allowed by special exception.
4. The property is historic but
nothing being proposed would
appear to alter the historic
qualities of the building or
neighborhood. The building is not being physically altered by the proposed short term
rental use. The 2009 Community Plan does encourage home-based businesses and
occupations while ensuring that these uses do not have an adverse impacts on
surrounding homes in terms of exterior appearance, traffic, noise, and other similar
disturbances.

5. The short term rental would be operated within the existing residence and the use
would not require any physical changes or land use implications that have a bearing on
the Town’s comprehensive plan. No changes are proposed to the neighborhood or to
204 Corsica Street.
Conclusion
I recommend that the Planning Commission provide a favorable comment indicating no impact
to the Comprehensive Plan and thus consistency with it.

Zone R2. After further reading into Residential District R-2 it was detbrmined that Special

the needed information to grant the subject property the Special Exception. The information
attached will give supporting documentation on the below items as listed in Article lll, District

Special Exception Application
I Rental agreements will be offered by the private owner through their own
rules and regulations, partnering with companies such as Airbnb.
Any shorlterm renters would be fully vetted out prior to taking possession
of the home. The vetting process would encompass the number of tenants,
the reason for stay, and past reviews. Tenants receive reviews from
Owners on Airbnb and VRBO. During any booking request, we are able to
review the tenents previous stays at other rentals and review all feedback
from Owners. Any reviews that are negative or people that don't have
reviews would not be permitted to stay. For all guests provide a Welcome
Book prior to their stay, that explains all house rules and obligations. This
book is emailed prior to checking in as well as printed and located in the
entrace way of the home.

Dear Mr. Fritz:
Our firm has been asked to review the Declaration of Covenants, Restrictions, and Right-
of-Way recorded among the Land Records of Queen Anne's County in Liber 0497, folio 518, a
copy of which is attached as Exhibit A (hereinafter the "Declaration"). As you are likely aware,
the Declaration encumbers the real properties located at 200, 204, 208 and 212 Corsica Street,
Centerville, Maryland 21617 (hereinafter "Lots 6, 7, 8, and 9", "Lots" or singularly "Lot").
As way of background, the Declaration was created in 1995 when Lots 6,7,8, and 9 were
jointly owned by William F. Grovermann and Norma M. Grovermann. The central purpose of the
Declaration, beyond establishing the rights of access over the "stone drive" located at the rear of
the Lots, is to provide for the maintenance and repair of the "Common Maintenance Areas". The
Common Maintenance Areas are defined to includes the "stone drive", all portions of the Lots
planted in grass, fencing, and the exterior brick stairs which lay between the Lots. ,See Art. [ $ a.
Beyond addressing these limited matters the Declaration puts no encumbrances, restrictions of use,
or obligations on the Lot owners. Indeed, Art. I $ b specifically limits the scope of the Declaration
by providing that it is not intended to "...restrict in any manner the usage by the Owners of the
Lots...".
To manage and provide for the maintenance and repair of the Common Maintenance Area,
the Declaration mandates the establishment of an Owners Committee. See Art. V $ a. The Owners
Committee is made up of the respective owners of the Lots. Id. Each Lot owner is entitled to one
vote and the Declaration provides that in order to transact business a quorum of three of the four
Lot owners is required. See Art. V $ b. To approve any measure, a majority vote is required. 1d. A

vote that results in a tie would defeat the proposed action. 1d. While, only a quorum is necessary
for the Owners Committee decide matters related to its limited purpose, the Declaration itself
cannot be amended or terminated without the consent of all Lot owners. See Afi. VI $ f.
As indicated above, the Owners Committee's authority is expressly restricted to exercising
the limited power granted to in under the Declaration. See Art. V g c. That authority is limited to
providing for the maintenance and repair of Common Maintenance Areas. See Art. V $ c & d. The
only obligation the Owners Committee is empowered to impose upon a Lot owner is for the
payment of annual and special assessments to fund the maintenance of the Common Maintenance
Areas. See Art. V $ e. Beyond this, the Committee cannot compel a Lot owner to undertake any
action or refrain from making any use of their Lot, renting their Lot to third persons, or engaging
in any other activity.

RE: Board of Education – Concept Plan and Special Exception

Introduction
The Applicant, the Queen Anne’s County Board of Education, has submitted a concept site
plan for developing a new Board of Education office building on a County-owned lot with
frontage on Vincit Street and Ruthsburg Road (MD Route 304). See page 2 of this Memo for a
copy of the concept site plan. The property is zoned R-2. The proposed use, a public office
building, is permitted only by Special Exception in the R-2 zone. The term “special exception” is
defined by the Zoning Ordinance in Section 170-68 as follows.
We have referred the Application to the Planning Commission per Section 170-59B1(d) of the
Zoning Ordinance, in order that the Commission might evaluate the proposed use for
consistency with the Comprehensive Plan and comment, if necessary. The Board of Appeals
must ultimately decide whether to approve or deny a special exception. As provided in Section
170-59B(f), the Board must find that a proposed special exception:
“will not adversely affect the public health, safety, security, morals, or general welfare or result in
dangerous traffic conditions, or jeopardize the lives or property of the people living in the
neighborhood”.
The Board of Appeals will examine the concept plan but will not approve or deny it per se. The
Board’s role is to review the use and consider how the use at its proposed location would
impact adjoining properties, roads, the public welfare, etc. Should the Board approve the
special exception, the Applicant will then prepare a formal site plan for Planning Commission
review.

Comments
At this time, the Applicant has prepared and submitted only a concept plan. The Centreville
Zoning Ordinance does not provide a concept plan review stage as part of the site plan
approval process. Therefore, no formal action is required with respect to the concept and no
decisions are being requested. This concept is being provided so that preliminary issues and
topics can be discussed and where feasible, the Commission’s concerns can be incorporated
into a formal submittal which would follow. Should the Planning Commission have any feedback
or wish to discuss any overall concerns, now would be a good time.

So, to be clear, the intent now is not to conduct a detailed site plan review. However, the
concept plan has benefitted from initial comments by the Town’s Technical Advisory
Committee and the project engineer and architect have conducted an extensive meeting with
the town planner to discuss the location of the project, the Town’s comprehensive plan, the
Applicant’s overall building design and development program, long range traffic circulation,
and other related matters.
Here are my concept level comments for your consideration prior to the presentation the
Applicant will make on December 21, 2022.
1. The site is 7.3 acres in size which is larger than needed for the proposed use. Some
portion of this site would remain undeveloped at least for the time being and may
potentially be improved in the future. Under that scenario, the land could eventually be
subdivided, and a site plan could be submitted in the future.
2. The site is split zoned. The northern portion is zoned R-2. The southern portion is zoned
C-3. The main building complex would be placed mostly if not entirely on the R-2
portion in close relationship to the existing Queen Anne’s County government office
building and developing YMCA. This placement reinforces the institutional center that
has emerged which includes the High School on the opposite side of Ruthsburg Road.
The proposed building does not include the County’s Aspire Academy, which would
have been instructional space.
3. A government office building in the R-2 zone is a use permitted by special exception
only. The Zoning Ordinance provides the Planning Commission an opportunity to offer
comments to the Board of Appeals regarding the use’s consistency with the
Comprehensive Plan before the Board decides whether to approve the special
exception.
4. The current draft Comprehensive Plan, which will be the subject of a public hearing on
January 18, 2023, recommends “Institutional” for this property—which aptly describes
the proposal. It also calls for a wider road section – a parkway—along MD Route 304,
which is relevant to the concept plan evaluation discussed below.
5. The use, as a governmental agency office building, is consistent with the adopted
Centreville Community Plan, 2009. It is proposed to be in what—in the 2009 Community
Plan–is shown to be Growth Area 4, overlaid with a designation called the Mixed-Use
Corridor. The property area was previously annexed, consistent the 2009 Community
Plan, and provided with municipal services, also consisted with the Community Plan.

6. The generalized intent of the 2009 Community Plan with respect to the site is that land
uses including commercial and institutional be developed as part of a mixed use
corridor extending from then-Town limits eastward to U.S. Route 301. The intent was
that vehicle access and circulation would be served with a public street running along
MD Route 304 so that driveway connections onto Route 304 could be minimized. Vincit
Road serves that function in this context. It is also worth noting here that the 2009
Community Plan expressly recommends that “Rte. 304 between Centreville and Rte. 301
be upgraded to four lanes with left turn lanes at key intersections” (pg. 4-18). This
recommendation – while not a use matter per se, is relevant to the discussion later in
this Memo about the need to reserve/dedicate land for expanded road rights-of-way.
7. The intersection of Kidwell Avenue and Ruthsburg Road (MD Route 304) is important
from a traffic standpoint. The concept plan shows a previously planned right-of-way
reservation in this area and along the frontage of Ruthsburg Road. As best as I can tell,
there are no detailed plans for a roundabout at this location or detailed roadway plans.
However, roadway reservations are advisable. This is especially the case along a major
section of the Ruthsburg Road frontage where the right-of-way is only 50 feet wide and
near the intersection with Kidwell Avenue.
Additional right-of-way width would be required along MD Route 304 to accommodate
future street expansion, biking/walking trails, and generally the parkway design that is
contemplated in the draft Comprehensive Plan. Recall from the Commission’s
comprehensive plan work sessions in 2022, more roadway capacity is needed over time
in this corridor to support future flows of traffic. Please see below the attached draft Plan
map which designates MD Route 304 as a parkway. Also see the attached image below,
which is a precedent for the design of the parkway.

8. To provide the space needed for the
roadway design and comply with zoning
setbacks, buffer yards, etc., the building
shown on the concept plan would need
to be moved somewhat to the south and
west. This is feasible without disrupting
the site plan, and the development team
and I can discuss this at the meeting on
December 21.
9. The building architecture responds to the
unique program requirements of the Board of Education, the unique shape of the site,
the architecture of surrounding buildings, and the objectives of environmental
sustainability. The project architect will be able to explain these features and the goals
of the design and generally how the building plan addresses the Centreville Design
Standards Ordinance.
10. Overall, this would be a one-story building with varied roof lines and orientations to
capture passive solar gain—i.e., using building design to capture the sun’s energy to
light and warm or cool the building. The roofs are also slanted southward to convey rain
water to the stormwater management facilities located in the parking area.
Conclusion
I recommend the Planning Commission provide a favorable comment to the Board of Appeals
indicating that the proposed use is in fact consistent with the Town’s comprehensive plan.
Following the Board’s decision on the special exception, the Applicant would return to the
Planning Commission with a site plan for Planning Commission review and approval.

Background:
Currently reviewed as a Concept Plan. Proposed development of 7.3 acre parcel located on the southeast corner of Maryland
Rt. 304 and Vincit Streetin the Town of Centreville. The applicant proposes construction of a 33,100 square foot office
building and supporting site features/amenities.
STORMWATER MANAGEMENT:
Stormwater Management Report Comments:
1. The applicant has submitted a conceptual stormwater narrative, concept report, and site layout. The plan was of
sufficient detail to evaluate the proposed stormwater management system at the Concept level:
a. General drainage patterns on the property were shown via existing topography,
b. Location of existing conveyances/culverts and their perceived function/adequacy as part of the developed
site was demonstrated.
c. Anticipated location and dimensions of all proposed impervious surfaces was included,
d. Geotechnical study guiding BMP selection will be submitted during Site Plan, but the mapped soil
classification and fill characterizes were discussed in the report.
e. Conceptual selection, location and suitability of all stormwater practices to be used was considered.
f. The applicant provided a narrative that describes the passage of post-development runoff and how ESD
will be implemented to the MEP.
2. In subsequent Site Plan reviews, submit for engineering review a stormwater management plan. Plan shall be of
sufficient detail for a comprehensive evaluation of the proposed stormwater management system and shall
demonstrate the following:
a. General drainage patterns on the property,
b. Location/condition of existing conveyances/culverts and whether facilities are adequate to convey runoff
from the site,
c. Anticipated location and dimensions of all proposed impervious surfaces (structures, decks/patios,
walk/driveways, etc),
d. Selection, location and adequacy of all stormwater practices to be used,

e. Design plan/profiles for selected stormwater facilities,
f. Perpetual Maintenance guidelines, and
g. Narrative that describes the passage of post-development runoff and how ESD will implemented to the
MEP.
3. Channel protection volume is required. Generally, when ESD to the MEP is achieved – and thus maintaining
post-development RCN as woods in good condition for the 1-year storm – Cpv requirements are satisfied. Thus if
you demonstrate that the entire target rainfall is treated using ESD, you will have satisfied the requirement such
that additional channel protection volume is not required.
Regarding additional quantity control, your preliminary submittal shall present pre & post-development volumes
for the 2, 10 and 100-year rainfall events, enabling us to assess the potential for damage to downstream properties
or structural controls during larger storm events. Your analysis shall address the adequacy of existing
downstream conveyances to safely pass increased volumes, if any, during the larger rain events. In the event
there is concern regarding damaging downstream flood conditions as a result of the development, Q , Q or Q

control may be required for Overbank Flood Protection or Extreme Flood Volume, respectively. Your report
preliminary report/calculations will be instrumental in determining whether quantity control beyond ESD to the
MEP storage will be necessary.
4. It is proposed that water quality will be addressed by applying Section 5.3 Alternative Surface Environmental Site
Design (ESD) credits, specifically A-2 Permeable Pavements, thereby satisfying Rev and WQv requirements (in-
part) and mitigating the need for structural practices. We approve of this application of ESD to the maximum
extent practicable (MEP).
5. It is proposed that water quality will be addressed by applying Section 5.4 Non-Structural & Micro-Scale
Environmental Site Design (ESD) credits, specifically TBD.
6. Upon final SWM plan approval, individual calculations must be re-submitted which support the sizing of each
BMP facility within each sub-drainage area.
7. Please ensure plans are of sufficient detail for the builder to interpret and properly implement the proposed SWM
plan.
8. The Limit of Disturbance (LOD) must be used to establish the ESD Target Volume for the overall development.
Plan Review Comments:
1. Sheet C1.02:
a. The easternmost SWM area is currently in a high area relative the development. We understand that the
entire site is subject to further grading, and that may make this moot. Otherwise, consider moving the
SWM area closer to the entrance.
b. Use a ribbon curb at all proposed permeable paver edges that are abutting grass or landscaping.
c. Use parking blocks
1. Where parking is against sidewalks (recommendation, QAC DPW defers to the Town and owner)
2. Where permeable pavers are used. If tires go into the grass and then back onto the pavers, the
fine sediments will contaminate the pavers and cause them to fail prematurely.
d. Non-regulatory Comment: The two isolated parking spaces may have safety issues backing out into
oncoming traffic (recommendation, QAC DPW defers to the Town).
e. Non-regulatory Comment: Consider using concrete in the “driveway” area opposite the two isolated
parking spaces. This will be better for load bearing in front of the dumpster, and will provide distinction
between the bituminous travel lane and the loading/unloading area driveway (recommendation, QAC
DPW defers to the Town and the owner).
f. Non-regulatory Comment: The proposed patio is north-facing which may lead to snow/ice melt issues in
the winter, and moss/mold at other times of the year. DPW recommends that the owner considers this and
coordinates with the architect as to whether a design change is warranted.
g. Non-regulatory Comment: We recommend adding a concrete walk from the patio area to Vincit Street
(recommendation, QAC DPW defers to the Town).
h. Non-regulatory Comment: Consider adding dedicated EV charging spaces.

General Comments:
1. Provide the following documents when submittal is made for final approval & signature:
a. Cover letter specifically responding to comments provided herein, including sheet references.
b. Plat and/or plans signed/sealed by engineer or land surveyor.
c. Executed stormwater MIA w/associated plat.
d. SWM Completion Form(s).
e. Completed DPW Checklist for Plan Signature.
2. Copies of final, approved plans shall be delivered as follows:
a. Engineering/Roads: 1 full-size plans and 1 CD w/.pdf files of plans, SWM Completion Form, MIA &
SWM Report
b. Owner: 1 CD w/.pdf files and 1 paper copy (minimum)
RECOMMENDATION:
QAC DPW Recommends Concept Level Approval at this time. Please resubmit for additional Site Plan review.

Dear Mr. Fortunato:
At the regular session of the Centreville Planning Commission on Wednesday, October 19,2022, the
Preliminary Site Plan was reviewed for a proposed restaurant and drive-thru located on Tax Map O44E Parcel
0098. The Planning Commission granted a conditional approval of the preliminary site plan.
It was determined the following items should be addressed by the applicant prior to Final Site Plan review:
a Compliance with the bufferyard and landscaping requirements - The four planned deciduous street trees
are to be distributed throughout the site as opposed to along the Rt. 213 frontage; the bufferyards should
stay, with thinning allowable in the northern side but two bufferyard deciduous trees are required,
leaving one in the southwest corner of the lot to grow to its full potential along with installing a 3-foot-
tall evergreen hedge to effectively screen the parking lot and drive-thru lane from view of Rt. 213.
Signage details - location, sizes, and illumination to include any wall/flat building signage, window
signs, on-site free-standing signage, and menu board specifications to comply with Section 170-38,
Attachment 9:1. The 6-foot maximum height limitation for a monument sign must be adhered to. The
site plan should show the location of the monument sign.
