Town Council of Centreville January 16, 2025 7:00 p.m. M I N U T E S The January 16, 2025 Town Council meeting was called to order at 7:00 p.m. by President Ashley H. Kaiser at the Liberty Building located at 107 North Liberty Street, 2nd floor meeting room. The following members and staff were present: Ashley H. Kaiser, President; Jeffrey D. Kiel, Vice President; Jim A. Beauchamp, Daniel B. Worth, and Sandra L. Huffer, Members; Carolyn Brinkley, Town Manager; Sharon VanEmburgh, Town Attorney; Clifford “Kip” Matthews, Director Public Works; Jenial Turner, Program Manager; Chief Robert L. Hobbs, Centreville Police Department; and Gaye Adams, Town Clerk. • Following the Pledge of Allegiance, Mr. Kiel made a motion to approve January 2, 2025 meeting minutes, with amendments. Mr. Worth seconded the motion, which passed unanimously. Citizens Comments Mr. Christopher Mulhall, Senior Manager of Government Affairs, introduced himself to the Town. Comcast will soon be available, and he wanted to express his desire to enter into a franchise agreement with the Town. Appearances a. Brandon Davis – DMS & Associates- Hillside Update • Brendan Mullaney, Attorney; Brandon Davis, Project Engineer with DMS & Associates; and Greg Torchio of Torchio Architects were present to discuss the Hillside Liquor project proposed for 425 S. Commerce Street. • Mr. Mullaney provided background on the property and the project. The proposed redevelopment of the property includes a 6,356 square foot first floor and a second story of the same square footage. The liquor store will be on the main floor and six apartments on the second floor. • The letter included provides further details and has two requests from the Council to consider. 1.) approval for water and sewer allocations for the proposed uses and 2.) approval to relocate the existing pedestrian easement on the southern portion of the property to proceed in the permitting and site plan processes. 2025-01-16-TC-Minutes Page | 1 2025-01-16-TC-Minutes Page | 2 • Mr. Torchio talked through the new architecture and oriented the Council to the different facades. • Below are the revised architectural drawings per the Planning Commission’s Request. • Roof top deck for recreation for the tenants and the various elevations. 2025-01-16-TC-Minutes Page | 3 • Mr. Beauchamp asked Mr. Torchio if the mechanical components were behind the wall on the roof. Mr. Torchio confirmed that is correct. • Ms. Huffer asked if the rendering on the top left is the view from the bridge. Mr. Torchio said that yes it was. Bottom left is the southeast corner toward the SHA property. • Mr. Kiel asked where the Fire Department connection is located. It will be on the front right corner by the intersection and the stair tower. • After a discussion of the architectural aspects, the easement was discussed. The first sheet shows the 2009 proposed 15’ easement. The second sheet depicts the new proposed 15’ easement. 2025-01-16-TC-Minutes Page | 4 • Mr. Davis provided clarification of the easement indicating that in 2009, the property line was just behind the existing sidewalk and prior to the bridge work that was completed in 2019, the State Highway Administration (SHA) purchased a portion of the property fronting Commerce Street. • Mr. Mullaney clarified that the relocation of the easement is proposed, requested, and necessary because the designed layout of the project including the storm water features is to minimize the impacts to sensitive environmental areas of the site. • Mr. Davis explained why the storm water features conflict with the easement as it exists today. The layout as proposed is to avoid non tidal wetlands. The unique design of the retaining wall is to keep that outside of the stream and the non-tidal wetlands. • Mr. Beauchamp asked how tall the retaining will be. The top of the retaining wall would be about 2.5’ of existing grade. • Ms. Kaiser asked if DMS had discussed these plans with the SHA? Mr. Davis stated they did not. Ms. Kaiser asked if they had spoken to SHA regarding the entrance to the property as proposed. Mr. Dixon stated they have met with the District 2 SHA liaison regarding the property. • Mr. Worth stated the easement is 15’ wide, a walking trail is 6’ wide so there would be room for adjustment if necessary. • Mr. Mullaney re-stated his request to the Council of approval for water and sewer allocation for the proposed uses and approval to relocate the existing pedestrian easement on the southern portion of the property to proceed in the permitting and site plan processes. 2025-01-16-TC-Minutes Page | 5 • Ms. Kaiser would like to hear from SHA regarding the proposal that is on their property. • The 2009 easement is from the Town’s work to tie to the existing Millstream Trail • Ms. Kaiser is looking for the public benefit and the public good for the changes in the easement and approval of EDU’s. • Mr. Beauchamp would like to walk around the site with Mr. Davis • Ms. Huffer agreed with Ms. Kaiser that this is a complex project and really wants to hear from SHA. • Mr. Kiel feels 24’ is wide enough for a truck to turn into the entrance. • Mr. Mullaney highlighted that this is a minor modification of an easement that allows the project to begin. The Town needs housing and this project does offer 6 new units to the town. It also allows the resident who is a business owner in the town to expand his business. • The apartments would be market price units. • Mr. Worth was ready to approve and is satisfied with the easement but due to the Council needing further information he defers to the Council President. • Mr. Beauchamp moved to table the Hillside requests for further investigation. New Business a. Waste Water Treatment Plant Update - Clifford “Kip” Matthews Director of Public Works • Jenial Turner, David Nixson, Engineer, Whitman, Requardt & Associates and Kip Matthews provided an update on the upgrade and expansion of the Wastewater Treatment Plant (WWTP). • Mr. Nixson stated the project will be moving forward with an upgrade to Enhanced Nutrient Removal (ENR) and using Membrane Bioreactor technology. This is what is recommended and the most cost effective. The last time Mr. Nixson provided an update, Council members requested the cost to operate a Reverse Osmosis Treatment for the plant. It would cost the Town approximately $250,000 a year just in electricity and maintenance. This does not include the 250,000 gallons of rejected water that has to be disposed of. • Public Works is working on ways to expand the stream discharge by moving the outfall further out into the Corsica River. Use of the spray irrigation field will continue. Mr. Beauchamp asked if the effluent disposal is the most important part and Mr. Nixson said yes, and the current plan is the most economical. 2025-01-16-TC-Minutes Page | 6 • Mr. Nixson stated they are waiting for the final approval of the Preliminary Engineering Report (PER) from the Maryland Department of the Environment (MDE) • The mixing study is very important in helping to determine the location of the outfall. Three (3) samples of the Corsica River are taken in December, January, and February and again in April, May, and June. All the samplings occurred at 4 different points along the river. This is to have comparables once the plant is up and running for stream discharge. While working on the mixing study, Public Works is working with the Department of Natural Resources (DNR) to understand fish spawning areas in the Corsica River. • Mr. Matthews reported that the lagoon located at the spray field must also be expanded regardless of the discharge because that Town will be required to continue with spray irrigation. • Mr. Beachamp asked what the current capacity was of the permitted 542,000 gallons. Mr. Matthews stated capacity is at 80% and the amount that can be sprayed differs between a dry year and a wet year. • The lab renovations have begun and will be completed March 2025. • Moving forward, a lot of information is needed from DNR and MDE regarding the mixing study. • Mr. Worth asked if the lagoon schedule is the same as the proposed upgrade schedule. Mr. Matthews stated it is not and is planned to be constructed by December 2026. • Ms. Turner stated the current schedule and plan meets all the requirements from the State. 2025-01-16-TC-Minutes Page | 7 • Ms. Turner gave an overview of the funding situation for the plant upgrade. • Ms. Turner stated that the Town is required to recertify to retain the current Bay Restoration Funds (BRF) and staff plans to apply for additional Bay Restoration Funds. • The Congressional Directed Spending (CDS) funds are still available. • Public Works has set aside $2 million of the ARPA funds for the lagoon expansion. • Ms. Brinkley will investigate applying for additional CDS funds for certain aspects of the plant. • Ms. Kaiser stated CDS funds may not be available. • The gap of funding for the Wastewater Treatment Plant is approximately $20 million today. • Ms. Huffer has recommended another update in 6 months. Reports of Board and Commissions a. Maryland Municipal League • Mr. Beachamp mentioned the Legislative Session is underway. b. Council of Governments • Mr. Kiel stated the Council of Governments meeting will be held at the Liberty Building 5:30 p.m. on February 12, 2025. c. Park Advisory Board • Ms. Huffer stated the PAB meeting was held earlier in the week and the annual report, which highlights all the activities in 2024. • Discussed the bandshell, parking lot, lighting and walking path. • Fishing Derby is successful, and the movie night has not been. Further discussion regarding movie night has been tabled until the band shell is complete. • Once the bandshell is complete the Park Advisory Board will discuss what events should take place to bring the community to the Wharf? They will utilize Carol D’Agostino in helping with marketing the new space and events. d. Planning Commission • GTI came in for the final site plan review and it was tabled due to many questions and incomplete details for the expansion. • The shopping center for the business park final site plan was tabled as well for signage and parking issues. The moratorium is coming to an end in April and the Planning Commission has not had the time to update the code during the intended time frame. Mr. Worth has asked for a 3-month extension. • Ms. Huffer asked what EDU allocation is currently available and if it is tied to the moratorium. • Mr. Matthews clarified that while the spray field is a pinch point, a report will be made available to the Council near the end of February and beginning of March to report on how many EDU allocations are available. • He stated that ss long as the limitations continue to be met with the nitrogen and phosphorus and stay within compliance, the Town is good. • The Planning Commission has a work session scheduled for February 5, 2025 to work on the Code. • Ms. Kaiser stated the GTI letter included in the Council’s packets discusses the scientific readings from GTI trailers, those measurements are what is reliable. No drying is occurring currently. Reports of Department Heads a. Town Manager 2025-01-16-TC-Minutes Page | 8 • Ms. Brinkley stated interviews have been wrapped up for the open Administrative Assistant position. • Sent Council Senate Bill 204 which is the requirement to set the tax rate by June 1st rather than July 1, 2025. • Completed the Request for Proposal (RFP) for the Public Information Officer. • Tuesday the 21st is the Eastern Shore Association of Municipalities (ESAM) dinner at Fisherman’s Inn. • The midyear budget update will be on the February 6th Council agenda. • Town Offices are closed on Monday the 20th for Martin Luther King, Jr. Day. b. Police Department • Chief Hobbs provided the 2024Year End Review for the Centreville Police Department. • Update on the $96,000 Maryland Department of the Environment Community Grant were used to purchase two speed trailers along with 4 speed indicator signs. • Chief Hobbs requested the Councils input on the placement of the 4 speed indicator signs. c. Town Clerk • Ms. Adams stated she is attending the IIMC, International Institute of Municipal Clerks, Conference in Richmond January 21-24, 2025 Citizens Forum • No citizens comment. Council Roundtable • Vice President Kiel accepted an award for the Town of Centreville for the Town’s continued support of the Goodwill Fire Department. • Mr. Kiel also brought up GTI and the odor and stated that he has not smelled it as much as the residents have reported. • Ms. Kaiser stated property values have not come down since GTI has been in the town. • Mr. Beauchamp discussed tax assessment and snow removal. He stated the Town should apply for to be divided into thirds with SDAT (State Department of Assessments and Taxation) the way the State does it. Mr. Beauchamp expressed disappointment in the lack of sidewalk clearing and would like to get a letter out to those individuals who did not clear sidewalks, and impose a fine for the next offense. • Mr. Worth also discussed that it wasn’t helpful having the plows push the snow in front of the sidewalks. • Mr. Worth, Ms. Huffer, and Ms. Adams attended the economic forum meeting with Queen Anne’s County. Great presentation that can be found online at https://choosequeenannes.com/ • Ms. Huffer liked the economic forum as well, and stated the County did express concerns with the State of Maryland deficit and how that would affect the County and the towns. • Ms. Huffer followed up on CEDA and Ms. Adams stated there are 7 applicants. • Ms. Kaiser thanked DPW for the snow removal even though it was a difficult job. Ms. Kaiser also stated Town staff does not need to tolerate disrespect from constituents and may refer such issues to her directly. Currently, departments should be at or around 50% of the budget spent. The following is information to further explain certain line items: General Fund Revenues • 67% received 6 months into FY25 • Variables that can affect this number are: o Property Tax – 65% received with the largest payment in October each year and the additional 35% to be received in the remaining months of FY25. o Local Income Tax – at 47% received, with an additional 53% expected to be received in the remaining months of FY25. General Fund Expense • All accounts in the General Fund are at or below 50% spent, except for the Cemetery, which is at 56% (Based on contract services cost). Enterprise Fund Revenues • At 47% received 6 months into FY25. • Variables that can affect this revenue are the timing of payments for utility bills made by residents, water/sewer allocations, and interest rates. Enterprise Fund Expense • All accounts in the Enterprise Fund are at or below 50% spent. Notes • Pension expenses for the entire year were paid in December; no more payments are coming out this fiscal year. • Debt payments in Enterprise Fund show no payments as the principal payments are not made on debt until April-May. Interest payments are paid out of expense accounts. Principal payments are paid out of liability accounts. • ARPA funds are obligated as of 12/31/2024. Majority of the evaluation was completed in what is referred to as the Northeast Quadrant of town (North Brook, Centreville Heights, etc.) and was completed in November of 2021 by Precision Concrete Cutting, a contractor the Town has used in the past on Town-owned sidewalks for repairs. This assessment was requested by previous Council Members to review the conditions and costs associated with the sidewalk repairs needed. This quadrant only includes approximately one quarter of the town’s total sidewalks, with each of the other three quadrants sidewalks in equally poor condition. You will see that a total of 917 trip hazards were identified with 845 (approximately 14,486 square feet) of them could be corrected by Precision Concrete Cutting trimming the misaligned joint areas. The 2021 price estimate cost was $202,802 to remove and replace these 845 critical areas, however by using Precision Concrete Cutting to trim these areas, would have cost $55,200. Not all the areas identified can be trimmed to eliminate the trip hazard so approximately 72 of these areas will have to be removed and replaced to correct the issues. Considering all this information, the Town can estimate the cost to trim all the trip hazards noted that can be addressed by Precision Concrete Cutting to be more than $234,048 and the estimated replacement cost to be more than $213,696.00. Aspects to be considered: There are many streets that have a curb against the sidewalk with no setback or green space between them. Precision Concrete Cutting guarantees that sidewalk trip hazard repairs will remain within your parameters for 3 years from the time of the initial repair. If any repair becomes outside your parameters due to continued lifting, sinking or any other natural causes created by normal pedestrian traffic. PCC will make the additional repairs at no additional cost to the customer. Precision Concrete Cutting reserves the right to refuse additional repairs if it is deemed that the additional repair is needed due to actions outside the limits discussed above, including heavy equipment or automobiles damaging the panel. 3.2 LEGAL A. Authorization. Precision Concrete Cutting removes only those trip hazards specifically requested by the client, and therefore makes no guarantee that the property is completely free of trip hazards after the work has been completed. Additionally, it is recognized that after completion of the contract, concrete / sidewalk trip hazards may and probably will continue to occur over time due to tree roots, water, settling, and other natural and man-made causes outside of Precision Concrete Cutting’s control. Upon completion of the contract Precision Concrete Cutting will not be responsible to remove trip hazards and is not liable for any related claims, losses, or damages. We will be operating on the 2nd half of our 4th year contract starting March 17, 2025, through June 30, 2025 • Upcoming yard waste collection charge $6,001.60 per month • Annual Total Cost $58,515.60 TOWN COUNCIL OF CENTREVILLE ORDINANCE NO. 01-2025 AN ORDINANCE OF THE TOWN COUNCIL OF CENTREVILLE TO AMEND CHAPTER 158 VEHICLES, NON-SELF PROPELLED WHEREAS, the Town Council of Centreville is authorized by § 5-202 of the Local Government Article of the Annotated Code of Maryland to adopt ordinances to protect the health, comfort, and convenience of residents of the Town of Centreville; and WHEREAS, Section 804.B.40 of the Charter of the Town of Centreville authorizes the Town Council to adopt Code provisions to remove nuisances and obstructions from the streets, lanes, and alleys and from lots adjoining thereto, or any other places within the limits of the Town; and WHEREAS, the Town Council believes that it is in the best interests of the citizens of Centreville to amend Chapter 158 of the Town Code regarding Vehicles, Non-Self Propelled. NOW, THEREFORE, BE IT ORDAINED by the Town Council of Centreville: Section 1. Chapter 158 of the Town Code is renamed Vehicles, Recreational And Utility Trailers Section 2. Chapter 158 of the Town Code is hereby amended as follows: 158-1 Definitions Recreational Vehicle or Trailer means a vehicular type portable structure or trailer designed for recreational, camping, living accommodations or other travel use which either has its own motor power and/or is mounted on or towed by another vehicle. These include, but are not limited to motor homes, truck campers, camping trailers, or trailers to carry boats, cars, animals, motorcycles or other off-road vehicles. 158-1 2 Stopping, Standing and Parking On Public Property Prohibited It shall be unlawful to stop, stand or park any non-self-propelled recreational vehicle or trailer while said vehicle is not attached to a motor vehicle, on any streets, alleys, or lanes or other public property within the Town of Centreville, except during the loading or unloading of such recreational vehicle or trailer when such loading or unloading is completed within forty-eight (48) hours of such parking. A non-self-propelled vehicle shall include, but is not limited to, any trailer, including boat trailers, house trailers, utility trailers, livestock trailers, carriage, sleds, buggies or other type of vehicle normally towed behind a motor vehicle, horse, oxen or other similar type of beast of burden. However, this chapter shall not apply to any carriage, sled, or buggy parked on any streets, alleys, or lanes within the Town of Centreville while the said carriage, bled or buggy is attached to said beast of burden. 158-3 Parking on Private Property An owner or occupant of a residential structure may store a recreational vehicle, or trailer owned by the property owner or occupant on their property provided that: A. If stored in the front yard of the property, the recreational vehicle or trailer shall be parked on the driveway or driveway apron; B. If stored in the side or rear yard of the property, the recreational vehicle or trailer shall be visually screened from the neighboring property or public right of way with landscaping or fencing, unless the property owner on that side gives written consent for no screening; C. The recreational vehicle or trailer is operable and is currently registered in the home state of the owner or occupant of the property; D. No occupancy, either temporary or permanent, of a recreational vehicle or trailer shall be permitted; and E. If the owner or occupant of a private residential structure permits a guest or invitee to park a recreational vehicle or trailer in violation of this Section, then both the owner of the recreational vehicle or trailer and the owner or occupant of the property shall be in violation of this chapter. There shall be a presumption of knowledge and permission of the owner or occupant of the private residential structure if there is a recreational vehicle or trailer parked in violation of this Section by a guest or invitee of the owner or occupant. 158-2 4 Violations And Penalties A. Any person, firm or corporation violating any of the provisions of this chapter shall receive a citation, either in person or by having same placed in a conspicuous place on the vehicle, which he, she or it was using at the time of the violation of said provisions, to appear before the District Court of Queen Anne’s County, to answer a charge of violating the provisions of this chapter; provided, however, that if the person, firm or corporation may appear at the Town Office of the Town of Centreville within the times and dates designated by Article I of Chapter 154, Vehicles and Traffic, and pay the fine or fines set forth in § 1-14.B.5.a of the Town Code; the payment of such fine, shall have the effect of dismissing the citation. B. In any prosecution charging a violation of this chapter, proof that the particular vehicle described in the summons was parked in violation of the chapter, together with proof that the defendant named in the summons was at the time of such parking or other unlawful act the registered owner of such vehicle, shall constitute prima facie presumption that the registered owner of such vehicle was the person who parked and placed vehicle at the point, and for the time during which such violation occurred. 158-3 5 Presumption of Vehicle Ownership In any prosecution charging a violation of this chapter, proof that the particular non-self-propelled vehicle recreational vehicle or trailer described in the summons was parked in violation of the chapter, together with proof that the defendant named in the summons was at the time of such parking or other unlawful act the owner, whether registered or otherwise, of any such non-self-propelled vehicle recreational vehicle or trailer, shall constitute a prima facie presumption that the owner, whether registered or otherwise, of any such non-self-propelled vehicle recreational vehicle or trailer was the person who parked or placed such non-self-propelled vehicle recreational vehicle or trailer at the point where such violation occurred. If any section, clause, paragraph, sentence or phrase of the Ordinance or the application thereof to any person, property, or circumstance is held invalid or unconstitutional by a court of competent jurisdiction, the invalidity or unconstitutionality shall in no way affect other provisions or any other application of this Ordinance which can be given effect without the invalid or unconstitutional provision or application, and for this purpose the provisions of this Ordinance are declared severable. Beauchamp, Member ______________________________________ Sandra Lee Huffer, Member TOWN COUNCIL OF CENTREVILLE ORDINANCE 02-2025 AN ORDINANCE OF THE TOWN COUNCIL OF CENTREVILLE EXTENDING THE TEMPORARY MORATORIUM FOR AN ADDITIONAL PERIOD OF THREE (3) MONTHS ON THE APPLICATION FOR, APPROVAL OF, CONSTRUCTION OF, EXPANSION OF, PROCESSING OF, OR ISSUANCE OF BUILDING PERMITS FOR ANY SUBDIVISION, SITE PLAN, OR BUILDING PERMIT APPLICATION FOR ANY RESIDENTIAL OR MIXED-USE PROJECT WHERE THE ANTICIPATED EQUIVALENT DWELLING UNITS (EDUS) EXCEED SEVEN (7) EDUS FOR THE TOTAL PROJECT PENDING CONSIDERATION AND ADOPTION OF REVISED ZONING ORDINANCE PROVISIONS AS THE TOWN COUNCIL MAY CONSIDER ADVISABLE AND TO ADOPT AN UPDATED CAPACITY MANAGEMENT PLAN AND SEWER ALLOCATION POLICY WHEREAS, the Town Council of Centreville has the authority under Section 5-213 of the Local Government Article of the Annotated Code of Maryland, to enact and administer a zoning ordinance, which is Chapter 170 of the Centreville Town Code; WHEREAS, Section 4-102(6) of the Land Use Article of the Annotated Code of Maryland authorizes the Town Council of Centreville to develop and adopt zoning restrictions to promote the health, safety, morals or general welfare of the community, including the location and use of buildings, signs and structures on the land; WHEREAS, by Ordinance 08-2024 effective October 9, 2024, the Town Council of Centreville enacted a six (6) month moratorium on the application for, approval or, construction of, expansion of, processing of, or issuance of building permits for any subdivision, site plan, or building permit application for any residential or mixed-use project where the anticipated equivalent dwelling units (EDUs) exceed seven (7) EDUs for the total project pending consideration and adoption of revised zoning ordinance provisions as the Town Council may consider advisable and to adopt an updated capacity management plan and sewer allocation policy; WHEREAS, the Planning Commission has been diligently working on the zoning changes but needs additional time to finalize their recommendation, and the Town Council then needs the time to have the required public hearing and adopt a zoning text amendment and have the ordinance become effective; WHEREAS, the Town Council of Centreville wishes to extend the moratorium for an additional three (3) months in order to receive and consider the recommendation of the Planning Commission and adopt a zoning text amendment; and WHEREAS, the Centreville Planning and Zoning Commission considered the matter at its _____________ 2025 meeting and has recommended that the Town Council approve this Ordinance. NOW, THEREFORE, be it ordained by the Town Council of Centreville: Section 1. The recitals set forth above are incorporated herein by reference and made a part of this Ordinance. Section 2. The moratorium on the application for, consideration of, approval of, construction of, expansion of, processing of, or issuance of permits for any subdivision, site plan, or building permit application for residential and mixed-use projects where the anticipated equivalent dwelling units (EDUs) exceed seven (7) EDUs, is hereby extended for a period of an additional three (3) months. Section 3. During the moratorium, the Town (including the Town Planner’s office, the Building Department, the Planning and Zoning Commission, the Board of Appeals, the Town staff, and the Town Council) shall not process, consider, review, or approve any application, permit, or other approval under the Town Zoning Ordinance for any subdivision, site plan, or building permit application for a residential or mixed-use project where the anticipated EDUs exceed seven (7) EDUs. Section 4. The moratorium shall apply to applications currently pending before the Town, as well as, applications filed after the effective date of this Ordinance. However, it does not apply to any application as of the effective date of this Ordinance that has received subdivision approval, site plan approval, and/or a building permit and which has already been approved for allocations by the Town Council. Section 5. This moratorium is adopted to allow sufficient time for the Town to accomplish the following: a. Receive public input, specifically to have the Planning Commission review this issue and provide recommendations; b. Consider any revisions to the Zoning Ordinance; c. Update the Capacity Management Plan and Sewer Allocation Policy; and d. Consider all such other matters as the Town Council, Planning and Zoning Commission, and Town staff deem appropriate. Section 6. The Town Council shall have and reserves the right to extend or modify this moratorium for such additional period or periods and on such terms and conditions as it deems necessary for the health, safety and welfare of the citizens of the Town of Centreville. Section 7. If any section, subsection, sentence, clause or phrase of this ordinance or of the codes hereby adopted are, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance or those codes.
