129-1 Definitions

Certain words, as used in this chapter, are defined as follows: GARBAGE. Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food. LITTER. Any used or unconsumed substance or waste material which has been discarded, whether made of aluminum, glass, plastic, rubber, paper or other natural or synthetic material or any combination thereof, including but not limited to any bottle, jar or can or any top, cap or detachable tab of any bottle, jar or can, any unlighted cigarette, cigar, match or any flaming or glowing material or any garbage, trash, refuse, debris, rubbish, grass clippings or other lawn or garden waste, newspaper, magazines, glass, metal, plastic or paper containers or other packaging or construction material, or the waste of the preliminary processes of farming or manufacturing. PARK. A park, reservation, recreation center or any other area in the Town owned and used by the Town and devoted to active or passive recreation. PERSON. Any person, firm, partnership, association, corporation, company or organization of any kind.

PRIVATE PREMISES. Any dwelling, house, building or other structure used either wholly or in any part for private residential purposes, whether inhabited or temporarily or continuously uninhabited or vacant, and shall include any yard, grounds, walk, driveway, porch, steps, vestibule or mailbox belonging to or appurtenant to such dwelling, house, building or other structure. PUBLIC PLACE. Any and all streets, sidewalks, boulevards, parking areas open to the public, alleys and any and all public parks, squares, spaces, grounds and public buildings. REFUSE. All putrescible and nonputrescible solid wastes (except body wastes), including ashes, street cleanings, dead animals, abandoned automobiles, dismantled vehicles, other abandoned personal property and solid market and industrial wastes. RUBBISH. Nonputrescible solid wastes consisting of both combustible and noncombustible wastes, such as circulars, leaflets, pamphlets, wrappers, handbills, newspapers and all and any other printed material, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, building materials and other like materials, but specifically excepting political literature.

TOWN. The Town of Centreville.

129-2 Deposit Prohibited

It shall be unlawful for any person to throw, drop, discard or otherwise place litter of any nature upon any public or private property, other than in a litter receptacle.

129-3 Adequate Containerization For Certain Places And Events

Litter receptacles and their servicing shall be required at the following public places: sidewalks used by pedestrians in active retail commercially zoned areas, such that at a minimum there shall be no single linear 1/4 mile without a receptacle; buildings held out for use by the public, including schools, government buildings and railroad and bus stations; parks; drive-in restaurants; all street vendor locations; self-service refreshment areas; construction sites; gasoline service station islands; shopping centers; parking lots; boat-launching areas; and special events to which the public is invited, including sporting events, parades, carnivals, circuses and festivals. The proprietors of these places or the sponsors of these events shall be responsible for providing and servicing the receptacles such that adequate containerization is available.

129-4 Deposit In Bodies Of Water

No person shall throw or deposit litter in any fountain, pond, lake, stream or any other body of water within the Town.

129-5 Litter From Vehicles

No person, while a driver or passenger in a vehicle, shall throw or deposit litter upon any public place or private property within the Town.

129-6 Litter On Private Property

No person shall throw or deposit litter on any private property within the Town, whether owned by such person or not, except the owner or person in control of private property may maintain authorized private receptacles for collection. Such owner or person in control of private property shall at all times maintain the premises free of litter; provided, however, that this section shall not prohibit the storage of litter in private receptacles for collection.

129-7 Litter In Parks

No person shall throw or deposit litter in any park within the Town except in public receptacles and in such a manner that the litter will be prevented from being carried or deposited by the elements upon any part of the park or upon any street or other public place. Where public receptacles are not provided, all such litter shall be carried away from the park by the person responsible for its presence and shall be properly disposed of elsewhere.

129-8 Litter On Vacant Lots

No person shall throw or deposit litter on any open or vacant private property within the Town, whether or not owned by such person.

129-9 Sweeping Into Gutters And Streets

No person shall sweep into or deposit into any gutter or street within the Town any accumulation of litter as defined herein, including but not limited to leaves, grass clippings or other land or garden waste.

129-10 Responsibility For Keeping Premises Litter-Free

Persons owning or occupying a place of business or a place of residence shall keep the sidewalks, entrance walks and parking areas in front of or upon their premises free of litter.

129-11 Covering And Loading Of Trucks To Prevent Spills

It shall be unlawful for any vehicle to be driven, moved, stopped or parked on any public roadway unless such a vehicle is constructed, covered or loaded to prevent any of its load from dropping, sifting, leaking or otherwise escaping therefrom. Any person operating a vehicle from which any materials which constitute litter have fallen or escaped which could cause an obstruction, damage a vehicle or otherwise endanger travelers or public property shall immediately cause the public property to be cleaned of all such materials and shall pay the costs therefor.

129-12 Storage Of Tires

The storage of tires in areas zoned residential shall be prohibited, except that tires may be stored in a fully enclosed building or structure.

129-13 Construction Sites

It shall be unlawful for any owner, agent or contractor in charge of a construction or demolition site to permit the accumulation of litter before, during or immediately following completion of any construction or demolition project. It shall be the duty of the owner, agent or contractor in charge of a construction site to furnish containers adequate to accommodate flyable or nonflyable debris or trash at areas convenient to construction areas and to maintain and empty the receptacles in such a manner and with a frequency as to prevent spillage of refuse.

129-14 Sidewalks And Gutter To Be Kept Litter-Free

It shall be the duty of the owner, lessee, tenant, occupant or person in charge of any structure to keep and cause to be kept the sidewalk and curb abutting the building or structure free from obstruction or nuisances of every kind and to keep sidewalks, areaways, backyards, courts and alleys free from litter.

129-15 Enforcement

The provisions of this chapter shall be administered and enforced by the Police Department of the Town, and said Department is charged with the duty to enforce this chapter and, to that end, to make and sign complaints for violations in the Municipal Court of the Town.

129-16 Violations And Penalties

Violation of the provisions of this article shall constitute a municipal infraction, subject to the penalties provided in § 1-14.B.5.a of the Town Code. 129-17 Definitions

For the purpose of this article, the following terms shall have the following definitions: CATEGORY I WASTE - GARBAGE. Animal and vegetable waste resulting from the handling, preparation, cooking, and consumption of food. This also includes both combustible and noncombustible wastes, such as the packaging products containing the aforesaid food items, as well as cigarettes, Styrofoam, and nonrecyclable materials generated by the residences and businesses within the Town limits of Centreville. CATEGORY II WASTE - RECYCLABLE. All items that are considered recyclable by the Town's current recycling contractor, including, but not limited to: glass containers, plastic numbers 1 through 7, metal cans, cardboard, paperboard, egg cartons and mail. CATEGORY III WASTE - YARD WASTE. Tree limbs, leaves, and grass clippings.

CATEGORY IV WASTE - BULKY WASTE. Furniture, stoves, washers, dryers, small metal items, and building debris. CATEGORY V WASTE - APPLIANCES. Refrigerators, freezers, air conditioners, and water coolers containing chlorofluorocarbons (CFCs). CATEGORY VI WASTE. Tires. CATEGORY VII WASTE - UNACCEPTABLE MATERIALS. Animal carcasses, fuel cans/tanks, farm waste, hazardous materials, batteries, firearms, burned materials, and paint.

129-18 Fee For Dwellings And Commercial Establishments

All residential dwelling units and all commercial establishments shall pay a waste removal fee in the amount set by resolution of the Town Council for Category I, Category II and Category III waste.

129-19 Exemption

Those commercial patrons or users that are currently utilizing a private contractor shall be exempt from this waste removal fee.

129-20 Collection Of Category I Fee; Interest On Unpaid Charges The Category I waste removal fee referred to in § 129-18 above shall be billed and collected in the same manner as water and sewer user fees. All unpaid charges after the due date may be charged interest at the rate set by resolution of the Town Council. [Amended 1-21-2016 by Ord. 129-28 Definitions

129-29 Placement Of Waste On Streets Prior To Pickup

It shall be a violation of this article for any person, firm, or corporation, or their agents or servants, to place or cause to be placed any category of waste on the streets, sidewalks, alleyways or curbs of the Town of Centreville for a period of time to exceed 24 hours prior to the regularly scheduled pickup of the waste.

129-30 Construction Debris

All waste material resulting from building, renovation or repair work on buildings by a contractor or builder in the Town shall be removed and properly disposed of by the contractor, builder, or property owner and not placed on the sidewalks, streets, alleyways, or curbs for collection by the Town.

129-31 Limbs And Branches

No limbs or branches shall be placed on sidewalks, streets, alleyways, or curbs for collection exceeding four inches in diameter and exceeding more than 40 pounds per piece or bundle. Limbs shorter than one foot in length must be placed in a container for collection.

129-32 Preparation And Placement Of Category I Waste All Category

I waste shall be placed in a bag, in a container with a lid, and said container shall not exceed 96 gallons in volume per container. All containers shall be placed on the streets, sidewalks, alleyways or curbs for collection by the Town.

129-33 Leaves And Grass Clippings

All leaves or grass clippings placed on sidewalks or curbs for collection shall be placed in baskets, cans or containers for collection and shall not exceed 50 pounds per container.

129-34 Waste Generated Outside Town

Waste generated outside the corporate limits of the Town of Centreville shall not be disposed of or placed in any container for that purpose within the corporate boundaries of the Town.

129-35 Recyclables All Category

II waste deemed "recyclable" by the Town may be placed in a container or containers issued by the Town for the purpose of collection of recyclables. Additional recycling shall be placed in containers and are required to have a lid and proper "recycle" markings. Said container issued by the Town or additional containers shall be placed on the streets, sidewalks, alleyways, or curbs for collection in accordance with Town ordinances or regulations.

129-36 Burning Prohibited

There shall be no burning of leaves, garbage, or other rubbish upon the sidewalks, alleyways, and curbs of the Town. Editor's Note: See Ch. 35, Burning, Open.

129-37 Category VII Waste On Streets Prohibited No Category

VII waste will be collected or placed for collection on the streets, sidewalks, alleyways, or curbs of the Town.

129-38 Violations And Penalties

Violation of the provisions of this article shall constitute a municipal infraction, subject to the penalties provided in § 1-14.B.5.a of the Town Code.

129-39 Purpose

The purpose of this article is to protect the quality of water resources in and surrounding Centreville. Dogs, cats, and other household animals may cause non-point-source pollution if their waste is not properly managed. Studies have documented that bacterial matter generated by pet waste contributes to the degradation of water quality. Therefore, the proper management of pet waste shall be regulated in order to protect the public health and safety.

129-40 Definitions

For the purpose of this article, the following words and phrases and their derivations shall have the meanings stated herein: IMMEDIATE. At once, without delay. OWNER/KEEPER. Any person who possesses, maintains, houses, or harbors any pet or otherwise has custody of any pet, whether or not the owner of the pet. PET. A domesticated, household animal. PET SOLID WASTE. Waste matter expelled from the bowels of the pet; excrement.

PROPER DISPOSAL. Placement in a designated waste receptacle, or other suitable container, and discarded in a refuse container which is regularly emptied by a refuse collector, or disposal into a system designed to convey domestic sewage for proper treatment and disposal.

129-41 Restrictions

All persons owning or in charge of a dog, cat, or other domesticated household pet shall immediately and properly dispose of their pet's solid waste deposited on any property, public or private, not owned or possessed by that person.

129-42 Exemptions

A person owning or in charge of a disability assistance animal shall be exempt from the provisions of this article while such animal is being used for that purpose.
